After the kiss, Nichols suggested to the woman that they go to his house to “continue the appointment,” and the two had sex, according to the Sun‘s report. After that, Nichols reportedly stopped charging for his services, the Sun‘s report says.

The police affidavit said Nichols and the woman continued engaging in “sex therapy and ritual magic” until November. After the relationship ended, the woman reportedly asked for a refund. :lol:

:confusion-scratchheadyellow: "refund" of what when he wasn't charging?

I was also confused until the last paragraph about the crime since it sounded like he ended the professional relationship in order to date, but:
The Sun reported that in Florida, it is illegal for psychotherapists to “commit sexual misconduct with a client,” and that it is also illegal to do so with a former client when the professional relationship ended “primarily for the purpose of engaging in sexual contact.”
Who knew? I'd guess it happens a lot. I wonder if there's a mandatory cooling off period and then it's okay.

Should've hypnotized her into not telling anyone or to forget the relationship ever happened.
So, all of those advertisements on the back of comic books when I was a kid were true.

It wasn't a very well-written article. I don't know anything about hypnotist-patient sex law in Florida, but since it is Florida, it looks like he could have just shot her, claimed to have been "skeered for his life" and be better off. Or maybe tell the cops when they show up "you're not interested in me...you're not interested in me..."

64B4-10.003 Psychotherapist-Client Relationship.
A psychotherapist-client relationship is established between a psychotherapist and a person once a psychotherapist renders, or purports to render, clinical social work, marriage and family therapy or mental health services including, but not limited to, psychotherapy, counseling, assessment or treatment to that person. A formal contractual relationship, the scheduling of professional appointments, or payment of a fee for services are not necessary conditions for the establishment of a psychotherapist-client relationship, although each of these may be evidence that such a relationship exists.
(1) Sexual misconduct, as defined in Rule 64B4-10.002, F.A.C., with a client is prohibited.
(2) For purposes of determining the existence of sexual misconduct the psychotherapist-client relationship, once established, is deemed to continue for a minimum of 2 years after termination of psychotherapy or the date of the last professional contact with the client. However, beyond that 2 year time period, the mere passage of time since the client’s last visit with the psychotherapist is not the sole determinative of whether or not the psychotherapist-client relationship has been terminated. Some of the factors considered by the Board in determining whether the psychotherapist-client relationship has terminated include, but are not limited to, the following:
(a) Formal termination procedures;
(b) Transfer of the client’s case to another psychotherapist;
(c) The length of the professional relationship;
(d) The extent to which the client has confided personal or private information to the psychotherapist;
(e) The nature of the client’s problem; and,
(f) The degree of emotional dependence that the client has on the psychotherapist.
(3) The psychotherapist shall not engage in or request sexual contact with a former client at any time if engaging with that client would be exploitative, abusive or detrimental to that client’s welfare or if the sexual contact is a result of the exploitation of trust, knowledge, influence or emotions, derived from the professional relationship.
(4) A client’s consent to, initiation of, or participation in sexual behavior or involvement with a psychotherapist does not change the nature of the conduct nor lift the prohibition.

"2 years"! Wow, that sure sucks for horny, emotionally bonded people where there's no exploitation. Oh well, maybe it's better to be safe than sorry. Probably protects the psychotherapist from intentional honey traps and extortion, too.

The law is probably discriminatory in that it results in attractive, available women being denied psychotherapy treatment by therapists not wanting to be "horny, emotionally bonded..." :lol:

Apparently, bald 63 year-old Florida hypnotherapists are not deterred.

His defense could be: "C'mon, I do hypnosis, I'm not a real psychotherapist." :D

It's a fun article, but I can't see him doing any jail time assuming the relationship really was consensual and the patient isn't some poor damaged vulnerable creature with a history of sex abuse from a series of step-fathers and boyfriends. Probably ding his license, or an official "bad boy" letter, or a fine or something.

Thanks for the warning. I've not been in FL since 1975 when me and my Navy school buddy went to Ft Walton Beach in his Datsun 240Z for a weekend break from classes at NAS Meridian MS.

Looks like Mitch McConnell's son or maybe trump Jr after a six month hamberder binge. I guess the poor bastard just couldn't sleep and went out to see if he could beat off an alligator or two and found next to nothing, and the report doesn't mention anything about how he had been seen hammering several nails in random wood scraps utilizing his mutilated member.
