Brevard teacher first to lose job over Florida law requiring parent sign-off on preferred name




At an April 8 Brevard school board meeting, a parent holds up a sign in support of a Satellite High teacher whose annual contract was not renewed after she called a student by their preferred name without parental consent.

... During Tuesday's board meeting, Susan Pinsky, a mother of four, called Calhoun a "foundational teacher," adding that Calhoun had taught three of her children.

"She is one of those teachers that builds the character of the people that she teaches," Pinsky said. "She is a gift, and a teacher like that does not come around very often. So I implore you as a board to please reconsider your decision."

... On Tuesday, prior to the school board meeting, students distributed a petition around Satellite High with the goal of reinstating Calhoun, said Ryan Matrigali, a junior at the school. The petition garnered 284 signatures over the course of the day. A similar online petition had 1,655 names as of the end of the board meeting and has continued to gain traction, boasting nearly 6,650 signatures just after 6 p.m. Wednesday.

"This teacher was not committing a crime or posing a threat to her students like others, but rather making her students feel comfortable in their own skin and in the classroom," said Ryan....

Quinn Diaz, Brevard County resident and public policy associate at Equality Florida, the state's largest civil rights advocacy organization for LGBTQ people, said that respecting a student's name is the "easiest way for teachers to create a positive" learning environment.

"This dedicated teacher is being fired for recognizing a student in the same manner that we acknowledge our family, friends and peers who use a nickname, their middle name or a shortened name," Diaz said in an email to FLORIDA TODAY.

"Hundreds of students have spoken out in support of this teacher who is being ousted from the classroom at a time when we have a dramatic teacher shortage. Unfortunately, Governor DeSantis and the Brevard County School Board have prioritized culture wars at the expense of high-quality, beloved teachers."

ACLU of Florida called into question how Calhoun's removal would help students learn and thrive in a statement sent to FLORIDA TODAY Wednesday afternoon.

"Administrators should strive to retain great teachers, not toss them out merely for being respectful," said Daniel Tilley, legal director of the ACLU of Florida. "Every student deserves a learning environment where they feel seen, safe, and supported.”

In a joint press release issued Wednesday afternoon, Florida Defense of Democracy, Youth Action Fund, Moms for Libros, National Parents Union and Our Florida called on Brevard's school board to reverse their decision and renew Calhoun's contract.

"(This moment is) about standing up for students, supporting educators and preserving the moral backbone of our public schools," the release said. "Ms. Calhoun stood up for her student. Now it's time for us to stand up for her."

Trump Can’t Enforce Anti-DEI Directives in Schools, 3 Judges Say

Three federal judges on Thursday significantly limited the Trump administration’s ability to enforce a series of orders it’s issued telling the nation’s schools and colleges to eliminate much of their diversity, equity, and inclusion programming or risk losing federal funds.

Judges in the District of Columbia, Maryland, and New Hampshire all found the Trump administration’s anti-DEI efforts didn’t pass legal muster, but for slightly different reasons. Their orders came in response to three separate lawsuits led respectively by the NAACP, the American Federation of Teachers, and the National Education Association....

The judge in Maryland, Stephanie Gallagher, an appointee of President Donald Trump during his first term, found the administration hadn’t followed proper procedure in directing schools to eliminate DEI programs, which she said represented a significant policy change. She also found that the directive overstepped the federal government’s authority with respect to curriculum, which it’s prohibited by law from influencing or prescribing.

“The government cannot proclaim entire categories of classroom content discriminatory to sidestep the bounds of its statutory authority,” Gallagher wrote in her 48-page opinion in response to AFT’s lawsuit.

... Meanwhile, the judge overseeing the NAACP’s challenge to the anti-DEI directives, Dabney Friedrich in the District of Columbia, blocked the Trump administration’s enforcement of its certification directive.

A Trump appointee, Friedrich agreed that the directive was vague and that the certification order, with its tight timeline, “further exacerbates vagueness concerns.”

... “The federal government has no authority to dictate what schools can and cannot teach to serve its own agenda, and this ruling is an important step in reaffirming that,” Sarah Hinger, deputy director of the American Civil Liberties Union’s racial justice program, which partnered with the NEA, said in a statement.

“The court agreed that this vague and clearly unconstitutional requirement is a grave attack on students, our profession, honest history, and knowledge itself,” AFT president Randi Weingarten said in a statement. “It would hamper efforts to extend access to education, and dash the promise of equal opportunity for all, a central tenet of the United States since its founding.”

Derrick Johnson, president and CEO of the NAACP, called the ruling in his organization’s case “a victory for Black and Brown students across the country, whose right to an equal education has been directly threatened by this Administration’s corrosive actions and misinterpretations of civil rights law.”

“An elementary school teacher could seek to establish a class culture of equitable and inclusive treatment by asking her students sign a collective pledge to follow the ‘Golden Rule’ for the entire school year,” she wrote. “It is more than arguable that such a practice would come within” the dictionary definition of DEI.

White House Proposes Eliminating Head Start Funding in Sweeping Budget Cuts

... The Head Start program had already been hit this year by layoffs and funding lags, along with a glitch this winter that briefly locked preschool providers out of their federal accounts. The private and public schools that run Head Start classrooms are deeply reliant on federal money, and this year’s funding problems have caused some preschools to close temporarily.

Those closures cut off child care for hundreds of thousands of low-income families, for whom a day without work is often a day without pay.

The National Head Start Association said it was “deeply alarmed” by the administration’s proposal to stop funding the six-decade-old program.

“It reflects a divestment in our future,” said Yasmina Vinci, executive director of the NHSA, in a statement Thursday. “Eliminating funding for Head Start would be catastrophic. It would be a direct attack on our nation’s most at-risk children, their well-being, and their families.”

Head Start is more than just a preschool program, Vinci said. It provides meals and health screenings and helps level the playing field for children who might otherwise fall behind before starting kindergarten. Many Head Start children are in foster care or are homeless.

A lag in funding to Head Start since January has caused some Head Start preschool classrooms to close. The federal government has distributed $1.6 billion for Head Start from Jan. 1 through Tuesday, compared with $2.55 billion issued during the same period last year, according to the office of Sen. Patty Murray, D-Wash., which has been analyzing a federal database. Murray said the Trump administration had “slow-walked” funding appropriated by Congress.

“This administration believes we cannot afford to help families get preschool or help kids get basic health services, but we can afford trillions of dollars more in tax breaks for billionaires,” Murray said earlier this week. “It’s offensive and just plain wrong, and let me be clear: Democrats won’t let a proposal like this go anywhere in Congress.”

“But that doesn’t mean Head Start and so many other programs aren’t under grave threat—because Trump has proven he’ll ignore our laws and do whatever he can to break these programs on his own,” Murray said.

Head Start operates in all 50 states. Parents who otherwise would not be able to afford child care rely on it when they work or go to school. Supporters say that underscores the importance of Head Start to the economy and at-risk children alike.

Johnson’s War on Poverty, some Republicans have emphasized its shortcomings and criticized efforts to increase funding.
