When you believe some of the stuff the Colonel actually does, the more ridiculous the statement, the easier it is for him to believe.

And how is this not a homicide? Fifteen year old, who shouldn't have had ready access to a firearm in the first place, shoots through a window at something he can't identify. Wasn't being attacked, "intruders" weren't inside or apparently trying to get inside, kid apparently didn't try to call to his parents. But he wuz skeered, so he'll probably get off.

Re: Gun Legislation
After her 11-year-old son was suspended for twice bringing a loaded handgun to school, Linnea C. Holdren, 43, said the matter was pretty much beyond her control. "I can't lock up his guns," she told police. "They belong to him, and he has a right to use them whenever he wants to use them." (The boy was expelled in January, and Holdren, who is a teacher at her son's Shickshinny, Pa., elementary school, has been charged with felony endangerment.) Minors in Kansas City, Missouri, are not allowed to purchase cap pistols; they may buy shotguns freely, however.

She was probably afraid the kid would shoot her.
And she didn't take the conviction well... http://archives.timesleader.com/2007_32 ... Local.html

Re: Gun Legislation
Now we know why the boy wanted to be armed at home and in school.... She only got about halfway there, but it still took five Luzerne County deputy sheriffs to stop her and wrestle her to the floor.
She carried on while the jury told the 45-year-old she was guilty of one other charge and not guilty of one last charge.
But her continued cries led Court of Common Pleas Judge Chester Muroski to have her removed from court.
The deputy sheriffs had to carry her the entire way from the third floor to a vehicle outside the courthouse basement. Her bellowing cries echoed throughout the courthouse....
Linnea Holdren was a teacher at the school at the time....

2 guesses:
It's not officially a homicide until a medical examiner says so.
Authorities will meet with prosecutors to determine if it's criminal homicide.
Could just be inexact reporting.

It's said that the real menace in dealing with a five-year-old is that in no time at all you begin to sound like a five-year-old. Apparently a teacher surrounded by children all day, at work and at home, starts to act like one.

Yup. Even a fully justified police shooting is considered a homicide. Just not a criminal one.Vrede too wrote:It's not officially a homicide until a medical examiner says so.

"Accident." Right. Should be criminal negligence, but noooooo. It's at least as negligent as those people who forget their kids and leave them to roast in the car. Hell, they've taken away some people's kids because the kid snuck out an unlocked screen and got to the sidewalk. Maybe more to the story than just that, but still...
But if it's a gun, it's "accidental."![]()
Idaho couple whose 5-year-old fatally shot another child reach plea deal
... Rusty and Ashlee Lish were accused of the misdemeanor charges after prosecutors found they left a loaded .22-caliber rifle within reach of their youngster, who shot and killed 5-year-old friend Noelle Shawver last year while the pair were playing at the Lish home in the southeastern Idaho community of Chubbuck, according to legal documents.
Under terms of a deal struck with the state earlier this week, the Lishes agreed to plead guilty in exchange for a deferred prosecution that will see the case dismissed in two years provided the couple meets conditions of the legal agreement.
Those include a requirement that the Lishes attend a course on parenting, pay nearly $30,000 to the Shawver family and complete a community service project in which they design and deliver a presentation to families about the dangers of firearms and how to safely handle and store them, a court clerk said.
The couple also is prohibited from possessing firearms during the period, she added....

(1) It's a significant improvement on the usually successful "opps" defense;Vrede too wrote:"a deferred prosecution that will see the case dismissed in two years" - I'm surprised that you're applauding.
(2) dismissed in two years notwithstanding, it's a pretty substantial penalty for what usually goes unpunished - $30K, community service, and (at least temporary) loss of guns.
(3) it's Idaho, ferpetesake - could we really ask for more out of them?

According to state law, it's obviously OK for someone to get shot by a nut only in unsecured areas of an airport ... not in secured areas.
