Not sure if I'd call prosecutorial decisions arbiters of the constitution but I guess it's what we've got, but this is different.

I think the issue is one of terminology. Some assistant AG can declare anything he wants, and act on it, but that doesn't make it true until the Supreme Court has ruled. What he's actually issued is an opinion, which will of course be challenged in court.
